Dayle M. Van Hoose
Dayle M. Van Hoose co-manages the firm’s consumer defense practice group. Dayle’s practice primarily focuses on defending both single-plaintiff and class action lawsuits and arbitrations brought under federal and state consumer protection and commercial statues, including the Fair Debt Collection Practices Act, the Fair Credit Reporting Act and the Telephone Consumer Protection Act.
Being admitted to practice in Florida, as well as many district and appellate courts around the country, Dayle has successfully defended numerous banks, financial institutions and debt collectors. Dayle also counsels clients on developing policies and procedures to comply with such federal and state laws.
Notable Cases/Work
- Vanover v. NCO Financial Systems, Inc., 857 F.3d 833 (11th Circuit May 17, 2017) (Successfully defended summary judgment entered in favor of defendant in TCPA action against defendant. Following oral argument, the 11th Circuit affirmed the lower court’s entry of summary judgement in favor of defendant on improper claim splitting, an issue novel to the 11th Circuit.)
- National Collegiate Student Loan Trust 2007-1 v. Lipari, 227 So.3d 309 (Fla. 5th DCA Aug. 4, 2017) (Successful in overturning summary judgment entered against plaintiff on appeal before the Florida 5th DCA. Following oral argument, the appellate Court affirmed and agreed Florida notice of assignment statute did not apply or bar debt buyer plaintiff from filing suit.)
- Reyes v. Radius Global Solutions, LLC, Case No. 19-cv-61375 (S.D.Fla. January 10, 2020) (Successfully defended class action alleging violations of the FDCPA and FCCPA.)
Daniel v. Navient Solutions, LLC, Case No. 8:17-cv-0253 (M.D.Fla. Aug. 28, 2019) (Successfully defended class certification and ultimately obtained summary judgment in favor of student loan servicer in class action alleging violations of the FCCPA and Florida state laws.) - Fennell v. Navient Solutions, LLC, 2019 WL 3854815 (M.D.Fla June 14, 2019) (Successfully defended class certification in favor of student loan servicer in class action alleging violations of the Telephone Consumer Protection Act.)
- Gaza v. Navient Solutions, LLC, 2019 WL 645390 (M.D.Fla. Jan. 23, 2019) (Successfully obtained summary judgment in favor of student loan servicer in action alleging violations of the Telephone Consumer Protection Act.)
- Wolfe v. Emcare, Inc., 2015 WL 1346811 (M.D.Fla. March 24, 2015) (Successfully obtained summary judgment in favor of defendant alleging violations of the FDCPA and the FCCPA.)
