Louisiana Do Not Call Order Does Not Bar Debt Collection Calls

Unless and until the Louisiana Public Service Commission ("LPSC") invokes the Louisiana Emergency Do Not Call Order, Louisiana's emergency telephone solicitation restrictions are not in effect.  Moreover, even if the LPSC did invoke the Emergency Do Not Call Order, the restrictions do not apply to debt collection calls unless they include a telemarketing or sales element.  Read more

D.C. To Prohibit Debt Collection Through Early August

Pending the D.C. Mayor's signature, Washington D.C. is expected to enact a new law - B23-0733 - prohibiting debt collectors from attempting to collect debts from District of Columbia residents through at least early August.

Marks Misses the Mark In The 7th Circuit: Court Rejects Marks And Holds An ATDS Must Generate Random Or Sequential Numbers

On February 19, in Gadelhak v. AT&T Services, Inc., the 7thCircuit adopted the reasoning of the 3rd and 11th Circuits holding a dialing system is not an ATDS as defined by the TCPA if it does not store or produce numbers to be called using a random or sequential number generator, and, instead, exclusively dials numbers stored on a customer database.
